  2. The User consents to the Company using Voice Data for the following purposes: (1) Extracting and analyzing the User's issues, and proposing and generating optimal solutions (such as creative plans and media plans) (2) Training, developing, and improving the accuracy of the Service's AI models, and developing new features (3) Analysis for improving Service quality

The detailed handling of Voice Data, anonymization and pseudonymization measures, and other matters are governed by the Company’s Privacy Policy.
  4. When a User speaks in a manner that includes the voice or personal information of a third party other than the User (such as co-participants or the User's customers or employees) during a Hearing Session, the User is responsible for obtaining in advance the necessary consent from such third party for the recording, analysis, and use set forth in this Article. The Company shall not be liable for any dispute, claim, or damage arising from the User's failure to obtain such consent, and the User shall resolve the same at its own responsibility and expense.

Article 6 Advertising Performance Measurement and Handling of Measurement Data

  1. Where the User carries out ad delivery through the Company, the Company measures the performance of that ad delivery and obtains Delivery Performance Data, and the User consents thereto. This Article does not apply where the User uses only the ad production features of the Service and does not carry out ad delivery through the Company.
  2. Where, in addition to the preceding paragraph, conversions or other outcomes on User Properties are to be measured, the User shall install the Measurement Tags designated by the Company on its User Properties, or grant the Company the access necessary for the Company to install them. The User warrants that it has the lawful authority to install Measurement Tags on such User Properties. Where no Measurement Tag is installed, the scope of measurement is limited to Delivery Performance Data.
  3. Where Measurement Tags are installed, the User shall, at its own responsibility and expense, provide the notices and public disclosures, obtain the consents, and make the privacy policy disclosures required under applicable laws (including the Act on the Protection of Personal Information and the external transmission rules under the Telecommunications Business Act) with respect to the collection of information by Measurement Tags on its User Properties and the external transmission of such information to Advertising Platforms or other third parties.
  4. Where information obtained through Measurement Tags is expected to be acquired as personal data by an Advertising Platform, the User shall be responsible for ensuring that the consent of the data subject required under Article 31 of the Act on the Protection of Personal Information and other applicable laws has been obtained.
  5. The Company shall not be liable for any dispute, claim, damage, or administrative measure arising from the User’s failure to comply with the preceding two paragraphs, and the User shall resolve the same at its own responsibility and expense.
  6. Except in cases of the Company’s willful misconduct or gross negligence, the Company shall not be liable for degraded page load performance, conflicts with other tags, display defects, or other technical issues on User Properties arising from the installation of Measurement Tags.
  7. The User consents to the Company using Measurement Data for the following purposes: (1) Measuring, analyzing, and reporting on advertising performance for that User, and optimizing ad delivery; (2) After statistical processing, anonymization, or other appropriate processing such that neither any individual nor any specific User can be identified: creating benchmark data by industry and by media channel and other statistical data; training, developing, and improving the accuracy of the Service’s AI models and developing new features; and providing and publishing such statistical data as a feature of the Service; and (3) Analysis for improving Service quality and developing new features.
  8. When using Measurement Data for the purpose set forth in paragraph 7(2), the Company shall exclude the User’s name, the domains of its User Properties, and any other information capable of identifying the User, and shall aggregate the data at a level of granularity from which the results of any specific User cannot be inferred.
  9. A User that does not wish its Measurement Data to be used for the purpose set forth in paragraph 7(2) may request that the Company cease such use (opt out) by notifying the Company in the manner it designates. Even in such case, advertising performance measurement and delivery performance reporting will continue to be provided to that User.
  10. Figures based on Measurement Data provided by the Company are derived from data supplied by the Advertising Platforms and may not match the User’s actual transaction records, due to browser specification changes, cookie restrictions, ad blockers, and differences in each Advertising Platform’s measurement methods, counting rules, and attribution settings. The Company does not warrant the completeness or accuracy of such figures or their consistency with other metrics.
  11. Deletion of, and cessation of use of, Measurement Data already transmitted to an Advertising Platform is governed by the rules of that Advertising Platform, and the Company cannot guarantee that such deletion or cessation will be effected.
  12. Details of the handling of Measurement Data are governed by the Company’s Privacy Policy.

  3. The User consents to the Company’s personnel viewing the User’s account, input content, Generated Content, configuration settings, and Measurement Data, and changing the settings of that account in accordance with the User’s instructions or approval, in each case to the extent necessary to provide Support. The Company retains logs of such access and operations.
  4. Where the User grants the Company operating permissions for an Advertising Platform account, the Company may operate that account within the scope requested by the User. However, the Company will not start or stop the delivery of advertisements or change advertising budgets without the User’s express instruction or approval.
  5. The Company may record (by audio or video) and transcribe Support provided by telephone or online meeting, for the purposes of improving Support quality, preserving records of communications, and preventing disputes. The Company may use such recordings, transcriptions, and conversation logs for purposes corresponding to those set forth in Article 5, paragraph 2 (including training and development of the Service’s AI models); a User that does not wish to be recorded may choose to receive Support by email or chat. The detailed handling of such recordings is governed by the Company’s Privacy Policy.
  6. Advice, proposals, and other information provided by the Company through Support in relation to ad production and ad operations are provided for reference only, and the Company does not warrant any particular results (such as impressions, clicks, conversions, or revenue). The User makes all final decisions regarding advertising content and placement, and Article 11, paragraph 3 (verification of compliance with applicable advertising regulations) applies equally to advertisements produced or adjusted through Support.
  7. Where the User provides the Company with personal information of a third party (such as the User’s customers or employees) in the course of Support, the User is responsible for obtaining the necessary consent from such third party in advance.
  8. The Company may send important notices regarding the Service, notifications of outages and maintenance, and other communications necessary for operations by email or similar means without the User’s individual consent. The Company will send emails for advertising or promotional purposes only where the User has consented or where otherwise permitted by law.

Article 8 Fees, Media Costs, and Payment

  1. Fees for the Service ("Fees") are as set forth in the separate pricing schedule. Fees comprise the monthly subscription fee for the Service and the management fee set forth in paragraph 3, and do not include Media Costs (as defined in the following paragraph).
  2. Advertising placement costs payable to Advertising Platforms ("Media Costs") are borne by the User and shall be paid by the User directly to each Advertising Platform using the User’s own credit card or other payment method registered with that Advertising Platform. The Company bears no obligation to pay, and does not advance, Media Costs.
  3. Where the User carries out ad delivery through the Company, the Company invoices, in addition to the Fees, a management fee equal to five percent (5%) (exclusive of consumption tax) of the total Media Costs charged by the Advertising Platforms during the relevant calendar month. The management fee is calculated on the basis of the amounts confirmed in each Advertising Platform’s management console.
  4. Notwithstanding the preceding two paragraphs, where the Company and the User separately agree in writing (including by electronic record), the Company may advance Media Costs and pay them to the Advertising Platforms. In such case, the credit limit, any advance payment requirement, billing cycle, payment due date, advance handling fee, and other conditions shall be set forth individually in that agreement.
  5. Fees are closed at the end of each month and shall be paid by the last day of the following month, in accordance with the invoice issued by the Company and by the method the Company designates. Bank transfer charges are borne by the User.
  6. Unless otherwise provided, amounts stated in these Terms are exclusive of consumption tax and local consumption tax. The Company issues qualified invoices and states its registration number on each invoice.
  7. Fees once paid are non-refundable except where a refund is required by law. The Company bears no obligation to refund, compensate, or otherwise make good any Media Costs.
  8. If the User is late in making payment, the Company may charge late payment interest at the rate of 14.6% per annum from the day following the due date until payment in full, and may suspend the Service and any ad delivery carried out through the Company.
